Risk management product: claims defensibility

The impact of claims and their costs continues to be a drain for many organisations. In the current economic climate in particular, the need to identify ways of minimising the risk of claims and avoiding the diversion of resources which these represent has never been more pressing.

BLM has used its position in the market and its accumulated expertise on dispute resolution to develop a risk management product which is designed to provide a comprehensive solution to claims risks, analysing claims causes and taking steps to reduce claims exposure in all areas of a client's operations.

Our bespoke claims defensibility audits and training packages raise awareness of the causes of claims and help businesses fully understand how they can minimise their exposure to risk.

The audits and packages are designed to:

  • reduce the frequency of accidents/incidents
  • reduce the frequency of claims
  • improve awareness of the outcomes of claims
  • reduce the cost of claims by understanding that early admissions in cases with no defence will save costs in the long term – defending the indefensible is not an option
  • improve the welfare of all employees by improving safety awareness.

The ultimate benefit for you is the ability to significantly drive down the frequency and risks of incidents and claims. In addition, our training is useful in helping you communicate to your managers the contribution they can make in protecting the business.

Our defensibility reviews will look at your claims history to enable you to identify those incidents which:

  • are capable of being defended, in whole or in part
  • may be exaggerated or exacerbated
  • are spurious
  • are valid but where the impact should be controllable.

Claims defensibility is not just about improving knowledge and awareness of the risks you face from claims, but also involves making improvements in internal systems and processes. This will benefit your business and your employees in every sense as incidents are avoided and profitability enhanced.
