Fraud
BLM’s fraud teams handle both commercial fraud and fraudulent insurance claims. We receive instructions from insurers seeking advice on policy liability where the possibility of insurance fraud is suspected. We train our solicitors to be alert to the tell-tale indicators of fraud, with potentially fraudulent claims referred back to our clients.
The most common types of insurance fraud are:
-
bogus claims
- exaggerated losses
- fraudulent devices used to support an otherwise genuine claim.
We regularly advise on:
- whether a claim has been sufficiently exaggerated to amount to fraud
- the implications of recent case law where an insured uses a ‘fraudulent device’ to improve his/her prospects of obtaining settlement
- the consequences of an insured’s actions or statements and whether all benefit under the policy is forfeited.
