Occupational disease

Occupational disease claims continue to be a growing and constantly changing area of personal injury law. These claims differ from mainstream personal injury as many of the conditions/symptoms can also arise from non-occupational causes. Claims can be broadly divided into:

  • Asthma / Upper respiratory tract disorders
  • Cumulative back injuries

  • Hand Arm Vibration Syndrome
  • Noise Induced Hearing Loss
  • Stress
  • Work Related Upper Limb Disorders

Claims often arise from a workplace where many employees were exposed to the same regime and there is always the potential for ‘tail’ claims to follow from the first intimated claim. For this reason it is often inadvisable to consider an ‘economic settlement’ in isolation without taking into account the workplace and the potential for similar claims.
