Compensation charges to rise 3.5%

From 1 April 2010, charges recovered by compensators via the Compensation Recovery Unit for NHS treatment provided to claimants will increase by 3.5%.
In 2006, the Department of Health undertook a full consultation on draft regulations governing operation of the Injury Costs Recovery scheme. This included seeking agreement to continue the practice established under the previous Road Traffic Act recovery scheme, which meant updating the level of charges on 1 April every year in line with Hospital and Community Health Service inflation.
The 2010 increase will therefore apply to personal injuries sustained on or after 1 April. This will not be applicable to disease claims, unless the disease in question has been contracted as a direct result of an injury that falls within the scope of the scheme.
