Berrymans Lace Mawer’s 2010 disease conferences are designed to provide an update on the key legal and medical developments in disease claims during the last year. This year we are hosting a roundtable discussion, which will cover the various policy developments in the pipeline, as well the inevitable changes to the management of disease claims likely to result from the implementation of Lord Justice Jackson’s recommendations.
As in previous years, 2009 has seen many judgments dealing with asbestos liability. The highlights cover minimal asbestos exposure, asbestos lung cancer, foreseeability of pre-1965 exposure and the eagerly awaited Court of Appeal EL Trigger decision. As an introduction to presentations from Boris Cetnik and Dr John Moore-Gillon we will set the scene by reporting on the findings of the recent Asbestos Working Party report.
In the last two years our hearing loss and vibration presentations have focussed on practical workshops. This year we revert to legal updates from two of BLM’s specialist partners who will cover the latest developments, practical solutions and trends in claim management practices.
With an estimated 11.4 million working days lost in 2008/09, work-related stress has become the second most prevalent work-related illness. Our speakers, BLM partner Vanessa Latham and Professor Declan Murphy, will work through a case study to highlight issues of liability, medical causation and overlap with the employment tribunal.
The day concludes with the roundtable discussion on the many issues that will affect the management of disease claims over the next few years. A series of short presentations will be followed by a facilitated debate on key issues, providing delegates with informed cross-industry knowledge. We are delighted to be joined for this session by Senior Master Whitaker, who will specifically cover costs management and pre-litigation conduct.
