This is the market leading annual review of occupational disease litigation.
Asbestos litigation has dominated the headlines with the House of Lords decision in the pleural plaques test cases handed down in November. Recent developments include proposed legislation in Scotland to overturn the judgment; pleural plaques claims based on breach of contract; and the issue of when asymptomatic asbestosis and pleural thickening becomes actionable. As one major piece asbestos litigation concludes another begins with the interpretation of different employer liability policy wordings for mesothelioma claims.
Young v Catholic Care & Others is another highly important House of Lords decision – altering yet again the courts’ interpretation and application of the Limitation Act 1980 – impacting on disease and abuse claims.
Moving from the House of Lords to the Court of Appeal we have identified 8 important judgments applicable to disease claims dealing with: strict liability under the PUWER and COSHH regulations; the burden of proving asbestos exposure; causation in cancer claims (including mesothelioma); bullying and harassment; stress and the overlap with employment tribunal claims; and the manual handling operations regulations.
In the programme we have given particular focus to the topical issues of limitation; asymptomatic pleural thickening and asbestosis claims and Work Related Upper Limb Disorders
New to this years programme is a break out session before lunch when delegates will be split into groups to view demonstrations by clinicians in four specialists areas: spirometry; audiometry; vibrometry and upper limb disorders. Delegates will be able to experience first hand the tests involved in diagnosing and treating various occupational diseases.
